SUPPLEMENTARY MEDICINAL CERTIFICATEFor the innovations in the pharmaceutical field, the protection conferred by the patent can be extended by a Supplementary Medicinal Certificate SMC at the national or Community level, this certificate provides the same rights as the main patent, for a limited period of 5 years. PLANT BREEDER’S RIGHT, the plant breeder’s right provides an exclusive right to produce and to introduce on the territory, to sale all or part of the plant or any vegetative reproduction or multiplication element of the considered type or of the resulting types when their breeding requires the repeated use of the initial type.

As per the applicable laws, software can be protected by a patent just like in the United States, or by copyright like in France, kNOW-HOW. Know-how is defined as any  technical knowledge which is transmissible, not patented, not immediately accessible to the public and which someone would be ready to pay to procure, know-how as such can not be neither protected nor transmitted on the basis of the patent rights law.
